How to send a demand letter by certified mail

A demand letter's power comes from being provably delivered on a specific date. Certified mail with return receipt requested costs about the price of lunch and turns your letter into dated evidence you can hand a judge.

The six steps

  1. Step 1

    Print two copies and sign one

    The signed copy goes in the envelope. Keep the unsigned copy and write the tracking number on it once you have it.

  2. Step 2

    Address it to the landlord's legal address

    Use the address on your lease or the registered agent listed in your state's business registry — not just the leasing office drop box.

  3. Step 3

    Ask for Certified Mail with Return Receipt Requested

    At the counter, say exactly that. You want PS Form 3800 (certified) plus PS Form 3811 (the green card the recipient signs).

  4. Step 4

    Keep the receipt and the green card

    The receipt proves the date you sent it; the green card proves the date they got it. These two dates are what make your deadline enforceable.

  5. Step 5

    Photograph everything before you hand it over

    The sealed, addressed envelope and both forms. It takes ten seconds and removes any later argument about what you sent.

  6. Step 6

    Email the same PDF that day

    Same letter, same date, second record. Save the sent message.

What the letter itself should contain

  • Your name and address, the date, and the landlord's name and address.
  • A Re: line naming the rental address and the subject: security deposit demand.
  • Your move-out date, the deposit amount, and anything already returned.
  • The deadline your state sets, and whether it has passed — look yours up here.
  • A clear demand: a dollar figure, or an itemized accounting, or both.
  • A firm payment date, 10 to 14 days out, and how you want to be paid.
  • One sentence stating you will file in small claims court if that date passes.

Tone matters more than threats

The letters that get paid are calm, specific, and dated. Skip the insults and the all-caps. A landlord reading a letter that cites the statute, states a number, and sets a date understands they are looking at a small claims filing if they do nothing — and that is the point.

Common questions

What is certified mail with return receipt?
A USPS service that gives you a mailing receipt with a tracking number (PS Form 3800) and, with return receipt requested (PS Form 3811), a card signed by the recipient. Together they prove your letter was sent and received on specific dates.
How much does certified mail cost?
Expect roughly $9 to $12 for postage, certified service, and a return receipt. Prices change — the clerk will quote you the current total.
What if my landlord refuses to sign for the letter?
Refusal is usually not a defense. Keep the returned envelope unopened and the tracking record showing delivery was attempted, and send a copy by regular mail and email as well.
Should I email the demand letter too?
Yes. Email the same PDF on the same day. It creates a second, timestamped record and often gets a faster reply than the paper copy.
